Terms of Service
Welcome to notadate. These Terms of Service ("Terms") govern your use of the notadate mobile application and website (collectively, the "Service"), operated by notadate ("we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms.
If you do not agree to these Terms, do not use the Service.
1. Eligibility
You must be 18 or older to use notadate. By creating an account, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into these Terms. notadate is an adults-only community, and we do not permit anyone under 18 to create an account or use the Service.
If we learn that someone using notadate is under 18 -- or if we have a good-faith reason to believe they are -- we will remove their access and close the account.
2. Account Registration
To use notadate, you must create an account with a valid email address. You are responsible for:
- Providing accurate and complete information during registration.
- Maintaining the security of your account credentials.
- All activity that occurs under your account.
- Notifying us immediately of any unauthorized use of your account.
You may not create multiple accounts, use another person's account, or transfer your account to another person.
3. Acceptable Use
notadate is designed exclusively for platonic friendships and social meetups. By using the Service, you agree to the following:
3.1 Platonic Intent
notadate is not a dating platform. All interactions must be platonic in nature. Using the Service to pursue romantic or sexual relationships is a violation of these Terms and may result in account termination.
3.2 Prohibited Conduct
You agree NOT to:
- Harass, bully, intimidate, or threaten other users.
- Post content that is hateful, discriminatory, obscene, or sexually explicit.
- Use the Service for commercial solicitation, advertising, or spam.
- Impersonate another person or misrepresent your identity.
- Share another user's personal information (including their exact location) without consent.
- Use automated systems, bots, or scrapers to access the Service.
- Attempt to circumvent safety features, content moderation, or account restrictions.
- Engage in any illegal activity through the Service.
- Create proposals or attend meetups with the intent to recruit, sell, or solicit.
3.3 Community Guidelines
All users are expected to treat others with respect and good faith. notadate is built on the principle that genuine friendships require a safe and welcoming environment. We reserve the right to remove content and suspend or terminate accounts that violate the spirit of our community, even if the specific behavior is not explicitly listed above.
4. Content
4.1 Your Content
You retain ownership of all content you create and share through the Service, including profile information, photos, activity proposals, and messages ("User Content"). By posting User Content, you grant notadate a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute your User Content solely for the purpose of operating and improving the Service.
4.2 Content Moderation
We use a combination of AI-powered systems and human review to moderate content on the Service. We reserve the right to remove any content that violates these Terms or our community guidelines, at our sole discretion. Content moderation decisions are final.
4.3 Reporting
If you encounter content or behavior that violates these Terms, you can report it through the in-app reporting feature or by contacting us at safety@notadate.app. We investigate all reports and take appropriate action.
5. Safety and Privacy
Your safety is a priority. notadate includes several built-in safety features:
- Location stays fuzzy (neighborhood-level) until both users mutually confirm a meetup.
- Photo verification adds a layer of accountability; it is a safety signal, not identity confirmation.
- Block and report functionality is available for all users.
- AI-powered content moderation monitors conversations for safety.
5.1 Meeting People in Person
notadate helps adults find each other and plan to meet up, but every meetup happens between independent adults out in the real world. We are not a party to those meetups, we do not supervise them, and we cannot verify the identity, background, or intentions of any user -- even with photo verification and content moderation in place.
When you choose to meet someone you found through notadate, you do so at your own risk, and you are responsible for your own safety. To the fullest extent permitted by law, notadate is not liable for the conduct of any user or for anything that happens before, during, or after an in-person meetup. We strongly encourage you to meet in public places, tell someone you trust about your plans, and leave any situation that does not feel right.

5.2 No Background Checks or Identity Verification
NOTADATE DOES NOT CONDUCT -- AND DOES NOT REQUIRE -- CRIMINAL BACKGROUND CHECKS OR IDENTITY-VERIFICATION CHECKS ON ITS USERS, INCLUDING USERS WHO CREATE OR HOST ACTIVITY PROPOSALS. NOTADATE MAKES NO REPRESENTATIONS OR WARRANTIES AS TO THE CONDUCT, IDENTITY, BACKGROUND, HEALTH, PHYSICAL CONDITION, INTENTIONS, LEGITIMACY, OR TRUTHFULNESS OF ANY USER. PHOTO VERIFICATION AND AI CONTENT MODERATION ARE SAFETY TOOLS, NOT BACKGROUND CHECKS, AND DO NOT CONFIRM ANY USER'S IDENTITY, SAFETY, OR FITNESS TO MEET.

6. Assumption of Risk and Release of Claims
6.1 Assumption of inherent risks
You understand and acknowledge that meeting other people in person carries inherent risks, including but not limited to the risk of illness, bodily injury, emotional distress, disability, or death, and the risk of interacting with people who misrepresent themselves or who act carelessly or unlawfully. You have freely and voluntarily chosen to assume all such risks, whether known or unknown, arising from your use of the Service and from any communication, interaction, or in-person meetup with another user.
6.2 Release of the notadate Parties
To the fullest extent permitted by applicable law, you release and forever discharge notadate and its officers, directors, employees, agents, affiliates, and service providers (collectively, the "notadate Parties") from any and all claims, demands, damages, losses, liabilities, and causes of action of every kind, whether known or unknown, arising out of or in any way connected with (i) your interactions or communications with other users, (ii) any activity proposal, and (iii) any meetup or in-person encounter arranged through or facilitated by the Service.
6.3 Release of Proposal Creators
Because activity proposals on the Service are created and hosted by users, and not by notadate, you further release each user who creates or hosts an activity proposal (a "Proposal Creator") from claims based on that Proposal Creator's own negligence in connection with a proposal or meetup, to the fullest extent permitted by applicable law.
6.4 Waiver of unknown claims (California residents)
If you are a California resident, you expressly waive California Civil Code Section 1542, which states: "A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release, and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party." You acknowledge that you are releasing claims you do not know or suspect to exist.
6.5 Savings clause
If any portion of this Section 6 is held unenforceable under applicable law, that portion shall be limited or severed to the minimum extent necessary to make it enforceable, and the remainder of this Section 6 and these Terms shall remain in full force and effect.
7. Account Suspension and Termination
We reserve the right to suspend or terminate your account at any time, with or without notice, for any reason, including but not limited to:
- Violation of these Terms or community guidelines.
- Fraudulent, abusive, or illegal activity.
- Reports of harassment or unsafe behavior from other users.
- Extended periods of inactivity.
You may delete your account at any time through the app settings. Upon deletion, your personal data will be handled in accordance with our Privacy Policy.
8. Subscriptions and Payments
notadate offers both free and premium subscription tiers. During the current beta period, all features are available to all users at no cost. When premium subscriptions (notadate+) become available:
- Subscription terms, pricing, and features will be clearly communicated before purchase.
- Subscriptions will automatically renew unless cancelled before the renewal date.
- Refund policies will follow the guidelines of the applicable app store (Apple App Store or Google Play Store).
The core friendship-finding experience will always be free.
9. Intellectual Property
The notadate name, logo, design, and all related intellectual property are owned by notadate. You may not use our trademarks, logos, or brand elements without prior written permission. The Service and its original content (excluding User Content) are protected by copyright, trademark, and other applicable laws.
10. Disclaimers
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that:
- The Service will be uninterrupted, secure, or error-free.
- Any connections or friendships formed through the Service will be successful or safe.
- The information provided by other users is accurate, complete, or truthful.
- The Compass compatibility system will accurately predict interpersonal compatibility.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, NOTADATE AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.
OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM THESE TERMS OR YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR $100 USD, WHICHEVER IS GREATER.
THE FOREGOING LIMITATIONS APPLY TO ALL CLAIMS, WHETHER BASED IN CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, INCLUDING BUT NOT LIMITED TO CLAIMS ARISING FROM TRANSPORTATION TO OR FROM A MEETUP, ATTENDANCE AT OR PARTICIPATION IN (OR EXCLUSION FROM) ANY MEETUP OR ACTIVITY ARRANGED THROUGH THE SERVICE, AND THE ACTS OR OMISSIONS OF OTHER USERS OR THIRD PARTIES, WHETHER OCCURRING ONLINE OR OFFLINE.
NOTHING IN THIS SECTION LIMITS OR EXCLUDES ANY LIABILITY THAT CANNOT BE LIMITED OR EXCLUDED UNDER APPLICABLE LAW, OR ANY LIABILITY ARISING FROM NOTADATE'S OWN GROSS NEGLIGENCE, FRAUD, OR WILLFUL MISCONDUCT.
12. Indemnification
You agree to indemnify and hold harmless notadate and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorney's fees) arising out of or relating to your use of the Service, your User Content, or your violation of these Terms.
13. Dispute Resolution
Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You agree to waive any right to participate in a class action lawsuit or class-wide arbitration.
14. Changes to These Terms
We may update these Terms from time to time. When we make material changes, we will notify you through the app or by email. Your continued use of the Service after changes are posted constitutes acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the Service.
15. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.
16. Severability
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
